    Terms of Sale

    Minimum Order – We require a $125 minimum order. This can be any combination of separate parts and does not include shipping charges.

    Credit Card Payment - We accept Visa, MasterCard, American Express and Discover credit cards at time of shipment.

    Terms

    •       Net 30-day terms are available upon credit approval. Terms of payment are effective 30 days from the date of the invoice. Please call to learn more about how to qualify and apply for credit terms.

    Same Day Shipping – Same day shipping may be possible for in-stock catalog items that require no secondary operations, and only if the order is placed by 1:00 p.m. CST. Please call or email with questions to learn more about when your order will ship.

    Samples - We will offer a reasonable number of samples at no charge, under the following conditions:

    •       A customer’s FedEx or UPS account is provided
    •       If the customer does not have a FedEx or UPS account, a credit card must be provided from which to charge the cost of shipping.

    All pricing is subject to change without prior notification.

     

    Return Policy

    Products must be retained in the state in which they were received until further instructions are provided by Popco. Failure to notify us within 10 days of shipment will constitute the acceptance of the shipment.

    No returns will be granted without prior return authorization number given. Please contact Popco immediately to begin the return authorization process.

    Unauthorized returns will not be received.

    Customers are responsible for all freight charges related to returns.

    A restocking fee of 25% may be applied to a return of catalog items.

    For product exchanges, a 10% exchange fee may apply.

    No returns after 60 days from date of shipment.

    No returns on any custom products.

    No returns on items that have been damaged or altered by customer.

    No returns are accepted for quantities that exceed our stock levels – please call for more information.

     

    Shipping Information

    Freight & Delivery

    •       F.O.B.  POPCO, Minneapolis, MN.

    Damaged Goods or Shortages

    •       The freight carrier delivering the product is responsible for loss or damage to the products that occurs while in transit.
    •       Popco is not responsible for loss or damage of products while in transit
      • In the event that the damage is seen at the time of delivery, please mark on the bill of lading as “damaged” and briefly describe on the bill of lading.
      • In the event of loss or damage, please contact Popco immediately and Popco will, at its option, assist with the filing of the claim against the freight carrier.

    Drop Shipments to multiple locations– Drop shipments to multiple locations are available by request. A drop-shipment fee may apply.

    Blind Drop Shipments – Customers can supply shipping labels or we can ship in a plain box. We do this frequently and with complete confidentiality.

    Courier & Will Call – Orders placed from the Minneapolis, St. Paul area, can be delivered via courier or can be picked up. This is especially practical for large orders or orders for heavy products.

    Customers are liable for any costs related to rejected collect freight charges wherein POPCO is not at fault.

    Liability Notice

    Purchaser assumes all risk of liability and damages due to the improper use of our products.

    Purchaser determines suitability for the application of any product herein and assumes all risk and liability whatsoever in connection therewith.

    It is the responsibility of those who purchase from us, and/or their customers who apply our products, to select the proper part and to test those parts at a level that is commensurate with the nature of the application.

    Popco’s liability, under these terms shall not under any circumstances exceed the price paid by the purchaser to Popco.

     

    Warranty, Disclaimer, Limited Remedy

           Unless a different warranty is expressly specified on the applicable Product Information or Product packaging (in which case such warranty governs), Popco warrants that each Product meets Popco’s applicable Product specifications at the time it ships each Product.  POPCO MAKES NO OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ARISING OUT OF A COURSE OF DEALING, PERFORMANCE, CUSTOM, OR USAGE OF TRADE.  If a Product does not conform to this warranty, Customer’s sole and exclusive remedy is, at Popco’s option, repair or replacement of the nonconforming Product or refund of its purchase price.  Popco has no obligation under this warranty with respect to Products that are modified or damaged by Customer, including through misapplication, misuse, abuse, accident, neglect, or mishandling.  Customer must notify Popco within 10 days after receipt that it believes a Product is non-conforming and, thereafter, cooperate with Popco’s investigation of such claim, otherwise Customer waives any right or claim with respect to such non-conformance.  

     

         Limitation of Liability

          Except for the limited remedy above, and except to the extent prohibited by law, Popco is not liable for direct, indirect, incidental, special, punitive, or consequential damages (including, but not limited to, lost profits, revenue, business, opportunity, or goodwill) that directly or indirectly arise from or relate to Products, regardless of the legal or equitable theory asserted, including, but not limited to, warranty, contract, negligence, fraud, or strict liability.
